THIS NOTICE DESCRIBES HOW HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Our Privacy Commitment
The Health Insurance Portability and Accountability Act of 1996 (HIPAA) requires that health providers keep your medical and dental information private. We are required by the HIPAA Privacy Rule to provide you with this written Notice of Privacy Policy, which describes our current privacy practices. We reserve the right to change these practices and will provide patients with a new notice if changes occur.
Uses and Disclosures of Health Information
Your health information may be used in this dental office for the following purposes:
- Treatment Services: We may use or disclose your health information to all of our staff members, other dentists, your physicians, and other healthcare providers taking care of you.
- Payment and Health Care Operations: We use your information to obtain payment for services, and for quality assurance, training, and licensing. Upon your written request, we will not disclose to your health insurer any services you have paid for entirely out-of-pocket.
- Appointment Reminders: We may use your information to provide reminders via voicemail, text, email, or mail.
- Business Associates: We may disclose information to third-party “business associates” (such as software representatives or accountants) who perform services for us. They are legally required to safeguard your information.
- Family and Friends: At your request, or in an emergency based on professional judgment, we may disclose relevant information to family members or others involved in your care.
- Marketing and Research: We will not use your information for marketing or fundraising without your written consent. We may disclose information to researchers only after an institutional review board has approved the study and established privacy protocols.
- Legal and Public Requirements: We may disclose information when required by law, such as for public health activities, suspected abuse or neglect, national security, or workers’ compensation programs.
- Breach Notification: We will notify you if your Protected Health Information (PHI) is compromised through unauthorized access.
Sensitive Records
- Substance Use Disorder (SUD): These records are protected by strict federal regulations (42 CFR Part 2) and generally cannot be disclosed without written consent, a court order, or a medical emergency.
- Reproductive Health Care: We will not disclose protected health information to conduct investigations into or impose liability for the act of seeking or providing lawful reproductive health care.
Your Patient Rights
- Access: You have the right to inspect or obtain copies of your health information (written request required). Fees may apply for copies or postage.
- Accounting of Disclosures: You may request a list of instances where we disclosed your information for purposes other than treatment, payment, or operations over the last 6 years.
- Restrictions: You may request additional restrictions on how we use your information. While we are not always required to agree, we will abide by any agreement we make.
- Alternative Communication: You may request that we communicate with you via alternative means or locations (must be in writing).
- Amendment: You may request in writing that we amend your health information if you believe it is incorrect.
Questions and Complaints
If you have concerns about your privacy rights or believe they have been violated, please contact our HIPAA Coordinator. You may also file a written complaint with the Department of Health and Human Services (HHS). We will not retaliate against you for filing a complaint.
